Storage of access data in server log files

Subject to any further information herein, you can visit our website without providing any personal information. We only store access data in so-called server log files. These are browser type and browser version, operating system used, referrer URL, host name of the accessing computer, time of the server request, IP address. This data is used exclusively to ensure trouble-free operation of the site. We do not evaluate this data individually and do not link you to your customer account. However, we can see from statistical data, for example, for which browser types we can optimise the website. The processing serves our legitimate interests.


Data processing in connection with purchasing of products and services

We process your personal data on the basis of your consent, in order to fulfil contractual obligations and as necessary for the purposes of the legitimate interests pursued by us or by a third party (Art. 6 (1) (a), (b) and (f) GDPR). In particular, we process personal data in order to fulfil your orders for products and services, to deliver and invoice our products and provide our services, to communicate with you, to answer your enquiries, to offer assistance and special services, to develop and improve our offers, products and services and to support our marketing. When we ask you to provide us with certain personal information, we indicate whether the information is necessary. Required information is marked with an asterisk (*) or otherwise. All other information you provide to us is voluntary.

We collect your name, billing and/or shipping address, e-mail address and telephone number. You may also provide your European VAT identification number. We may collect data regarding vouchers or special promotional coupons that you have purchased and their redemption. We collect the data of your order and the selected payment method for processing your order. We also collect data relating to the payment and the retrieval of your scans as part of the performance of the contract.

We use your information and photographic material you send us to produce digital scans of your photographic material. By sending your information and photos, you guarantee that you are authorised to any such information and material for the use of our services and the purposes described herein. You also guarantee that you have the right to use and disclose the information and photos of any persons that are shown on your photos in accordance with the applicable laws. We are entitled to delete digital scans at any time at the lawful request of a third party shown on your photographs.

We might process and use your e-mail address in connection with your subscription to any newsletter; if you subscribe to a newsletter, we will also store information on your newsletter confirmation and your use of our information services. If you contact us directly, we may collect further information about your request, the response, including any correspondence in this regard.

We might use coupon information for billing, invoicing and statistical purposes and to better understand the impact of our advertisement.

Your personal data will only be used for other purposes if you have given your consent for any such further use, if we are entitled or obliged to use your personal data due to legal regulations, or to the extent we have explicitly reserved the right to use your personal data for other purposes that are permitted by law and about which we inform you in this privacy policy.


Retention periods for personal data

We store and process your personal data for as long as necessary to provide our services and, thereafter, for the duration of any statutory retention periods.

The scans of your photographic material will be stored for the duration of the relevant services you have book (in particular 30 days for HIGH QUALITY 4K scans and 3 months for FULL QUALITY 14K scans). Thereafter, we store the scans for up to 3 additional years for the purposes of offering an optional retrieval service in accordance with our General Terms and Conditions.


Transfer to third parties

We do not sell or market your data to third parties. We will only share your information with third parties to the extent necessary to fulfil our obligations or as otherwise permitted by law.

We work together with third party service providers in order to be able to provide our services. These service providers include in particular the providers of storage services, payment service providers and shipping services.

Depending on which payment service provider you have selected as part of the ordering process, we also pass on your data to the relevant payment service provider to the extent necessary to process the payment. In some cases, the selected payment service providers also collect certain data on its own behalf when you create or have created an account with such provider. In such case, you must register or log in to the payment service provider with your access data or account during the ordering process. We do not have access to your account or the login data required for this. The respective contractual provisions of the payment service providers and the data protection provisions stipulated by them apply to the processing of payments. 

If the respective service providers process your data outside the European Union, this may result in your data being transferred to a country with a lower data protection standard than that in the European Union. In these cases, we ensure that the service providers concerned guarantee an equivalent level of data protection by contract or otherwise.

We reserve the right to disclose data in exceptional cases due to court orders or to the extent necessary for the assertion or defence of legal claims.


Use of cloud services for sharing of scans

You agree to the digital delivery of scanned imagery and their storage by us using the third-party services of PicDrop GmbH, Am Treptower Park 28 – 30, 12435 Berlin, Germany (“PicDrop”) and Dropbox International Unlimited Company, One Park Place, Floor 5, Upper Hatch Street, Dublin 2, Ireland (“Dropbox”). 

We have entered into data processing agreements with such cloud service providers with storage locations within the European Union.

Please note that the cloud services providers may collect certain information when you use their services and download your scans from their websites. For details, please see the privacy and cookie policies of the relevant services providers set out above.


Use of data when subscribing to the e-mail newsletters

If you subscribe to our newsletter, we use the data required for this purpose or separately provided by you to send you our e-mail newsletter in accordance with your consent. Unsubscribing from the newsletter is possible at any time and can be done either by sending us a message or via a designated unsubscribe link in the newsletter.

We might evaluate your user behavior when sending newsletters. For this evaluation, the emails sent might contain so-called web beacons or tracking pixels. For the analyses, we link the above-mentioned data and the web beacons with your e-mail address and an individual ID. With the data obtained in this way, we may create a user profile in order to tailor the newsletter to your individual interests. In doing so, we record when you read our newsletters, which links you click on in them and infer your personal interests from this. We link this data to actions you have taken on our website. You can object to this tracking at any time by clicking on the separate link provided in each email or by informing us via another contact channel. The information will be stored for as long as you have consented to receive advertising. After unsubscribing, we may store the data purely statistically and anonymously.


No own credit assessment or scoring

We do not carry out a credit check ourselves and do not use our own credit scoring. However, a credit check and scoring may be carried out by the payment service providers selected by you as part of the ordering process. The respective contractual provisions of the payment service providers and the data protection provisions stipulated by them apply to the processing of payments.
